Did the machine torch come with the machine or was it fitted after ?
Some torches use only two wires to fire the torch and check if the torch cap is on, so when removing the hand switch they will be stuck on.
The only solution in that case would be to open the plasma and cut one of the thin wires from the torch and wire the torch on signal between that cut wire. That way the safety of removing the torch cap will still remain functional.

I know PCW says you can use the spindle relay but I built mine before I read his advice so I trigger the torch using a relay on an output pin. If you do this and use a electro-mechanical relay be sure to add a flyback diode across the relay coil contacts with the band pointing back towards the output pin.
I would try that and edit your hal file before panicking too much.

The main problem is the torch is coming on with the CNCport disconnected.

I would review the wiring internal to the torch. I know when I bought an Everlast and a machine torch, I had to modify the wiring in the torch to make it work as expected. I can't remember what the original behaviour was though sorry.
